Circular of the General Office of the Ministry of Commerce of the People's Republic of China, on Making Efforts to Accomplish the Review Work of Production Permit of National Filature Enterprises
Administrative commercial sectors (tussah silk offices) in all the provinces, autonomous regions and municipalities:
In accordance with regulations of administration permissions reserved in State Council decree No.412, 2004 and General Office of State Council Circular on Transmitting Suggestions to Sate Tussah Silk Coordination Team and General Association of China Textiles on Adjusting Processing Ability of Filature and Silk (No.16, 2997), review of the producing licenses of the national filature enterprises that will expire by the end of 2005 should be carried out in time. Related matters are now announced as follows:
Relevant departments should insist the principle of controlling the total quantity, adjusting structure, eliminating those of unable, and promoting enterprise’ level of technique equipment and producing in line with the local tussah silk materials during review of the producing license. Based on market demand of recent years, the total quantity of filature between 2006 and 2007 are initially determined to be 2,350,000 threads. Related matters like conditions to obtain producing license and punishment on enterprises without license are subject to General Office of State Council Circular on Transmitting Suggestions to Sate Tussah Silk Coordination Team and General Association of China Textiles on Adjusting Processing Ability of Filature and Silk (No.16, 1997) and the Former State Economic and Trade Commission, the People’s Bank of China, the Former State Administration for Industry and Commerce and the Former State Bureau of Quality and Technical Supervision Circular on Printing and Distributing Implementing Measures on Producing System of Filature and Silk (No.479, 1998).
Provincial administrative commercial departments are responsible for the preliminary examination of the producing license. Producing-license-applying enterprises must earnestly fill out the Application Form for Producing License Review of National Filature Enterprise (please refer to Appendix 2), and report to prefecture (city) administrative departments of tussah silk; prefecture (city) administrative departments of tussah silk are responsible to report information of preliminary examination to provincial administrative commercial departments (tussah silk office).
In accordance with total quantity of appendix 1 and conditions to obtain producing license, provincial administrative commercial departments (tussah silk office) will examine all local filature enterprises together with silk associations (companies) at the same level, recoding the producing licenses of the qualified enterprises, and submit related materials to Ministry of Commerce (sate tussah silk coordination office) and China Silk Association as well.
Ministry of Commerce (sate tussah silk coordination office) will uniform the producing license and only eligible enterprises in the review can get it. State tussah silk coordination office will be responsible for the specific works of the review.
Provincial administrative commercial department (tussah silk office) should assign special personnel to carry out work of producing license review and report materials like contacts, phone number and fax to state tussah silk coordination office.
