Fresh Cocoon Purchase Qualification Measures (hereafter Measures) was jointly issued by the Ministry of Commerce and State Administration for Industry and Commerce to address the changing regional structure of cocoon production, standardize the application and qualification of cocoon purchase, and specify the implementing authority, the conditions and procedures of the qualification. The Measures will come into force on August 1, 2007.
In recent years, with the development of silk industry, the regional structure of cocoon production had undergone significant changes. A number of new production areas, most of which lacked the experience of cocoon purchase qualification and management, had posed tremendous problems for those enterprises engaged in cocoon purchase business, and caused inconveniences in their operation and application for qualification. After the promulgation and implementation of PRC Administrative Permission Law and State Council’s Decision on Administrative Permission for those Projects Requiring Administrative Examination and Approval, local authorities on silk industry and business called for the further standardization of cocoon purchase qualification, and demanded the expeditious establishment of qualification measures and the specification of its implementing authority, basic conditions, procedures and time limits.
The Measures was introduced to address this situation. It specifies the qualification standards and general procedures of cocoon purchase, and sets down punitive measures for activities violating cocoon purchase law. In order to guarantee the effective implementation of purchase qualification system, the Measures stipulates that the cocoon purchase license of enterprises would be annulled if they severely violate law, administrative regulations, or disturb the order of cocoon purchase business. In addition, The Measures encourages enterprises which span the realm of agriculture, industry and trade, to participate in the development of sericulture base. Also included in the Measures are the standardization of tussah purchase business and the specification of the authorities that grant cocoon purchase qualification.
The Measures is instrumental in keeping local commerce and business authorities working in line with the law, standardizing cocoon purchase qualification process, and building a more wholesome cocoon purchase market. It also helps protect the silkworm farmers’ interests and push forward the development of silk industry.
